This Privacy Policy describes the types of information about you (“personal information” or “personal data”) that Urban Science Applications, Inc., including our service providers or other third parties acting on our behalf, (“Urban Science,” “we,” “us,” or “our”) collects offline or online, including through our websites, mobile applications, or other online services and platforms (this “Site”), how that information is used, and the types of third parties with whom we disclose it. It does not apply to information collected through any other website provided by Urban Science that is governed by separate terms of use and privacy policies. The submission of information within the Urban Science Career Site of this Site is governed by a separate privacy policy located at https://www.urbanscience.com/career-site-privacy-policy/.

If you are visiting this Site from a country outside the United States, you acknowledge that in using this Site, you will transfer personal information about yourself to the United States, that the data protection laws of the United States may not be as comprehensive as those in your own country, and that the transfer of this personal information is necessary to provide you with information in accordance with your consent. The United States is generally considered to be a country without an adequate standard of data protection by the European Commission. Personal information collected on this Site is stored and processed in the United States, under the laws of the United States.

Urban Science may provide links to Internet sites maintained by others. These websites are subject to their own privacy statements. Urban Science is not responsible for the privacy practices of such third-party sites. Urban Science encourages you to read the privacy statement of every website you visit before you transfer personal information to them.

Urban Science may have collected the following categories of Personal Information in the twelve (12) months prior to the effective date of this Privacy Policy:

  • Name, postal address, unique personal identifier, phone number, email address, or other similar identifiers;
  • Commercial information, including records of personal property, products purchased, obtained, or considered, or other purchasing or consuming histories or tendencies;
  • Protected classifications characteristics under California or federal law, such as gender and marital status;
  • Commercial information, such as internet transaction information and purchase history;
  • Geographical data, which may configure sensitive personal information for Brazilian residents;
  • Professional or employment-related information, such as verification of employment;
  • Education information;
  • Inference drawn from any of the Personal Information listed above to create a profile about, for example, an individual’s preferences and characteristics; or
  • Sensitive personal information under certain privacy laws, such as driver’s license or state identification card.

1. Information you choose to provide
Urban Science may collect, store, and use personal information you choose to provide, for example, when you send us an email or complete any of our online forms such as the Application Form or the Contact Us Form, through your offline correspondence or personal contacts with Urban Science representatives, or when you request information or assistance through the Site. The personal information you provide may identify you and your business individually, and it may include items such as your name and email address, job title, company name and address, and phone number. You choose to provide any such information on a free basis, and if you refrain from providing certain personal information this may limit the value of our assistance and services. The information you provide via this Site is maintained by Urban Science or service providers acting on behalf of Urban Science. Urban Science does not purchase or otherwise obtain any supplemental personal information about you from any third parties not identified in this Privacy Policy. We process personal information you provide us with within the scope of and on the basis of providing this Site’s information services to you (service contract) or on the basis of your consent. Urban Science will limit its collection of personal information to what is adequate, relevant, and reasonably necessary to serve the purposes described in this Privacy Policy.

3. Information collected automatically
Urban Science may also use server log analysis tools to collect certain other information. This information may include your Internet Protocol (“IP”) address, your Internet Service Provider (“ISP”), and your domain name. An IP address is a number that is automatically assigned to your computer by the ISP through which you access the Internet; an ISP is a company that provides access to the Internet; and a domain name is the string of letters, numbers, and hyphens that is used to point to an IP address. Urban Science uses this information for system administration and to fulfill its legal obligations. Urban Science does not link IP addresses or domain names with any other personal information.

Urban Science may collect information via a number of other technologies, including cookies, web beacons, clear GIFs, and other means. If you visit our Site, the temporary storage of access data and log files takes place on the basis of providing this Site’s information services to you. In addition, our legitimate interest serves as a legal basis for the temporary storage of access data and log files. Our legitimate interest is to provide you with a technically functioning and user-friendly Site and to ensure the security of our systems.

Cookies
A “cookie” is a small text file that is transferred to your browser and stores information about your interactions with a particular website. A cookie is then read by the web server that placed it on your browser. It works as a sort of identification card, recording your preferences and recalling previously entered information. By using cookies, your navigation time is reduced, and use of a website is simplified.

Urban Science uses two types of cookies:

  • A “session” cookie is temporary and is deleted once you close your browser. Session cookies are used to help a user’s browser navigate a website more smoothly. Session cookies can also give helpful information.

Urban Science uses both session and persistent cookies to collect and store information that allows us to offer better customer service and ensure easy navigation through our Site.

Third Party Technologies
We may use or allow third parties to collect information about your online activities over time and across different websites when you use the Site.

For example, we use Google Analytics, a web analytics service provided by Google Inc., hereinafter “Google.” Google Analytics uses cookies to enable an analysis of how the Site is used. The information generated by these cookies will be transferred to Google in the United States and stored there. This information is then used to evaluate visitors’ use of the Site and to compile statistical reports on Site activity for Urban Science. Google may also transfer this information to third parties, provided this is required by law or if third parties process this data on behalf of Google.

We use Google Analytics with the addition “gat._anonymizeIp” on our Site. In this case, your IP address will be abbreviated by Google already within the Member States of the European Union or the European Economic Area and thus anonymized. Only in exceptional cases the full IP address will be transferred to and saved on a Google server.

Furthermore, you may use a Google deactivation add-on, which is accessible for most common browsers. The above cookie-based data processing is carried out to safeguard our legitimate interests or on the basis of your consent (legal basis). In particular, our legitimate interests are to be able to provide you with a technically optimized, user-friendly, and needs-oriented website and to protect the security of our systems.

4. How we use your personal information
Urban Science may use your personal information to:

  • Audit related to counting ad impressions to unique visitors, verify positioning and quality of ad impressions, and audit compliance;
  • Fulfill our legal and regulatory obligations in accordance with applicable laws and regulations in the relevant jurisdictions;
  • Provide our products and services to automotive manufacturers and dealers, which may include performing services, including maintaining or servicing accounts, providing customer service, processing, or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar services;
  • Improve, upgrade, or enhance our products and services, which may include debugging to identify and repair errors that impair existing intended functionality;
  • Provide information that we think may be of interest to you, which may include advertising and marketing services;
  • Help to ensure security and integrity to the extent the use of your personal information is reasonably necessary and proportionate for these purposes, including detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and prosecute those responsible for that activity; or
  • For research and analysis purposes.

We also use the information you provide us to contact you in response to any requests, complaints, or comments you may have about Urban Science.

To the extent that Urban Science sells or shares (for cross context behavioral advertising) your personal information, Urban Science will provide you with a right to opt out of such sales or sharing.

Urban Science will not use personal information unless reasonably necessary for and compatible with the purposes described in this Privacy Policy unless Urban Science has your consent.

5. Disclosure of your personal information to others
Except as described in this Privacy Policy, Urban Science does not disclose personal information about you with any parties outside of Urban Science.

If you send us an email or use our Contact Us Form to send us a request, complaint, or comment relating to any website that displays the Urban Science Seal, we may forward your request, complaint, or comment to the appropriate website and an Urban Science group company.

We may disclose your personal information:

  • to service providers that perform functions on our behalf in order to provide our products and services;
  • to our business partners, such as automotive manufacturers or dealer groups, regarding your use of the products and services that Urban Science provides to you;
  • to other categories of third parties, such advertising networks, internet service providers, data analytics providers, government entities, operating systems and platforms, social networks, and data brokers;
  • to a successor organization in the event that Urban Science is involved in a transaction such as a merger, stock purchase or sale, or sale of substantially all of Urban Science’s assets;
  • to our subsidiaries or affiliates for responding to your request (or who may be engaged under our instruction to provide products and services on our behalf) and to third party partners whom we may engage under our instruction to provide products and services on our behalf, including, but not limited to, support services, website services, and answering user questions about our services;
  • to other third parties with your consent; or
  • to comply with valid legal process such as a search warrant, subpoena, or court order, to protect our rights and property, or to protect the safety or security of the public, users of this Site, or of Urban Science’s services. We will disclose information when we believe in good faith that the law requires it.

6. Legal basis
The legal basis for the collection of information you choose to provide is either that (1) you gave a consent to the processing of personal data for one or more specific purposes, (2) the processing is necessary for the performance of a contract to which you are party (e.g., regarding the use of our Site or an information or support request), (3) in order to take steps at your request prior to entering into such a contract, (4) that the processing is necessary for the purposes of legitimate interests pursued by us or third parties, or (5) to comply with applicable legal and regulatory obligations.

As far as the data processing is based on your consent, you have the right to revoke this consent at any time by sending us a request or notice to any address stated above. The revocation of consent does not affect the lawfulness of processing based on consent before its revocation.

If you are located in the European Union, you have the right to object, on grounds relating to your particular situation, to the processing of personal data concerning yourself based on our legitimate interests, in particular by deactivating any such tools as explained under No. II.2. We shall then cease to process such data if we cannot demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms.

8. User Acceptance of & Changes to the Urban Science Privacy Policy
Urban Science reserves the right to modify or amend this Privacy Policy at any time and for any reason. When we modify the Privacy Policy, we will post on this Site a notice that it has been modified, and we will provide any other notice as required by applicable law.  Modifications will be effective on the date that appears on the modified Privacy Policy. Each time you use this Site, you should check the last updated / effective date of this Privacy Policy and review any changes made since the last time you visited the Site.

III. Additional Information


1. Protection of children’s online privacy
Urban Science understands the importance of protecting children’s privacy, especially in an online environment. The Site is not designed for or directed at children under 16 years of age. It is Urban Science’s policy not to knowingly collect or maintain information about individuals under age 16.

If we learn that we have collected personal information from an individual under 13 years of age without parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13 years of age, please contact us at privacy@urbanscience.com.

We have no actual knowledge that we have sold or shared any personal information of individuals under 16 years of age.

2. How we protect your personal information
We follow generally accepted security practices and procedures to protect the personal information about you from unauthorized access, use, and disclosure, and we require that our authorized service providers implement and maintain such security practices and procedures as well. Personal information is subject to reasonable administrative, technical, and physical measures to protect the confidentiality, integrity, and security of the personal information and to reduce reasonably foreseeable risks of harm to you. Nevertheless, Internet transmissions are never completely private or secure.  You understand that any messages or information you send to our Site may be read or intercepted by others. 3. Retention of your personal information
We will retain personal information about you for as long as it is necessary (a) to carry out the purpose(s) for which such information was collected, (b) to comply with applicable laws, contracts, or other rules or regulations, (c) provide our services, (d) resolve disputes, (e) establish legal defenses, (f) conduct audits, (g) pursue legitimate business purposes, (h) enforce our agreements, or (i) in accordance with our routine information storage policies and practices. Any retention will take into account the nature and purpose of the collection or use of the personal information. For example, Urban Science will retain for at least five years any data protection assessments conducted relating to the processing of your personal information.

If Urban Science deidentifies your personal information, we publicly commit to retain and use the deidentified personal information without attempting to reidentify the deidentified personal information.

4. Scope of your Obligations to provide Data
Generally, you are not obliged to provide us with your personal information. However, if you do not provide this information, we will not be able to make certain aspects of our Site available to you, answer your questions, or enter into a contract with you.

Further, you have the right to lodge a complaint with a competent data protection supervisory authority. The competent supervisory authority for the representative of Urban Science in Germany is the Data Protection Officer of the Federal State Hesse, Gustav-Stresemann-Ring 1, 65189 Wiesbaden. In Brazil, the competent supervisory authority is the Brazilian National Data Protection Authority (Autoridade Nacional de Proteção de Dados – “ANPD”).

1. Consumer Rights
This section describes the privacy rights consumers, who are residents of certain states (“Consumers”), may have about their personal information, which is determined by applicable state law and may vary based on the Consumer’s state of residency. For information on how Consumers may contact Urban Science to exercise these rights, please see the section below entitled, “How to Submit a Request.”

Right to Know
A Consumer may have the right to request that a business disclose what personal information it collects, uses, discloses, or sells/shares. Specifically, a Consumer may be able to request that a business that collects personal information about the Consumer disclose to the Consumer the following:

  1. The categories of personal information, including sensitive personal information, it has collected about that Consumer.
  2. The categories of sources from which the personal information, including sensitive personal information, is collected.
  3. The business or commercial purpose for collecting or selling/sharing personal information, including sensitive personal information.
  4. The categories of third parties with whom the business discloses personal information, including sensitive personal information. This may include a list of specific third parties, other than natural persons, to which Urban Science has disclosed personal information.
  5. The specific pieces of personal information, including certain sensitive personal information, it has collected about that Consumer. This may include a copy of all personal information that Urban Science has processed or is processing. Certain pieces of personal information may be withheld in accordance with applicable law.
  6. Confirmation as to whether Urban Science is processing or has processed your personal information.

Any copy of personal information provided will be in a portable and, to the extent technically feasible, readily usable format that will allow you to transmit the personal information to another person.

Right to Request Deletion
A Consumer may have the right to request that a business delete personal information, including sensitive personal information, about the Consumer. This may include personal information you have provided to Urban Science, personal information Urban Science obtained from another source, or personal information about you derived by Urban Science. If it is necessary for Urban Science to maintain the personal information for certain purposes, Urban Science is not required to comply with your deletion request. If we determine that we will not delete your personal information when you request us to do so, we will inform you and tell you why we are not deleting it.

Right to Opt-Out of Sale or Sharing of Personal Information
A Consumer may have the right to direct a business that sells or shares (for cross-contextual behavior advertising) personal information about the Consumer to third parties not to sell or share the Consumer’s personal information for such purposes. Urban Science does not sell or share Consumers’ sensitive personal information. Urban Science may sell or share Consumers’ commercial information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies to its customers for such customers’ internal business purposes. To exercise your right to opt-out, please submit a Request Form.

Right to Correct
A Consumer may have the right to correct inaccurate personal information that a business maintains about the Consumer. When correcting inaccuracies, Urban Science will take into account the nature of the personal information and the purpose for processing the personal information.

Right to Limit
A Consumer may have the right to direct a business to limit the use and disclosure of sensitive personal information. Urban Science does not use or disclose sensitive personal information except as permitted under applicable law.

Right to Opt-Out of Targeted Advertising and Profiling
A Consumer may have the right to opt out of the processing of personal information by Urban Science for the purposes of targeted advertising and profiling. With regards to profiling, such right is limited to such profiling that is done in furtherance of decisions that produce legal effects or effects of similar significance. Such opt out may be available to you through an opt-out preference signal. Urban Science will process requests sent via opt-out preference signals in accordance with applicable law.

If a Consumer’s personal information is used to profile in furtherance of decisions that produce legal effects or similarly significant effects, a Consumer may have the right to question the result of the profiling, to be informed of the reason that the profiling resulted in the decision, and if feasible, to be informed of what actions the Consumer might have taken to secure a different decision and the actions the Consumer might take to secure a different decision in the future. A Consumer may have the right to review the personal information used in the profiling, and if based on inaccurate personal information, the Consumer may have the right to have the personal information corrected and the profiling decision reevaluated based on the corrected personal information.

Right to Revoke Consent
A Consumer may have the right to revoke consent a Consumer has previously given to Urban Science for processing personal information. If Urban Science makes material changes to this Privacy Policy, a Consumer may have the right to withdraw consent to any further materially different collection, processing, or transfer of previously collected personal information under the updated Privacy Policy.

No Discrimination or Retaliation
A Consumer may have the right not to be discriminated or retaliated against because the Consumer exercised any of the Consumer’s rights under applicable state laws. Urban Science does not discriminate or retaliate against any Consumer for exercising any rights under applicable state laws.

Urban Science will not process personal information on the basis of a Consumer’s or a class of Consumers’ actual or perceived race, color, ethnicity, religion, national origin, sex, gender, gender identity, sexual orientation, familial status, lawful source of income, or disability in a manner that unlawfully discriminates against the Consumer or class of Consumers with respect to the offering or provision of: housing, employment, credit, or education; or the goods, services, facilities, privileges, advantages, or accommodations of any place of public accommodation.

2. How to Submit a Request
To exercise the rights described above, you must submit a verifiable Consumer request to us by contacting Urban Science through one of the following methods:

  • Call us toll-free at 800-321-6900 Monday through Friday, 10 a.m. and 5 p.m. United States Eastern Time Zone, excluding holidays.

You may submit a request as frequently as you would like, but we may not be required to respond to requests to provide personal information to you more than twice in any 12-month period. Urban Science may charge a reasonable fee to cover the administrative costs of complying with multiple requests in a 12-month period.

To submit a verifiable Consumer request, you will be asked to provide certain information to help us verify your identity. The information we ask you to provide to initiate a request may differ depending upon the type of request, the type, sensitivity, and value of the personal information that is the subject of the request, and the risk of harm to you that may occur as a result of unauthorized access or deletion, among other factors. In certain circumstances, we may also require you to provide a written declaration that you are who you say you are. We will match the information that you provide against our internal business records to verify your request.

You may also designate an authorized agent to make such requests on your behalf by submitting a written permission form establishing that the agent is authorized to act on your behalf (e.g., a signed power of attorney). We may require that the agent verify the agent’s own identity. A parent or legal guardian may exercise these rights on behalf of a child for whom the requestor has legal responsibility.

If we cannot verify your identity or authority to make the request, we will not be able to comply with your request. We will inform you if we cannot verify your identity or authority. We will only use personal information provided in a verifiable Consumer request to verify the requestor’s identity or authority to make the request.

You may have the right to appeal our decision or response to your request. To exercise your right to appeal, you can submit an appeal request by contacting us using the same method used to submit your original request, as described above, or by utilizing additional options for appeal that we may provide in our response.

V. Additional Information For Brazil Residents

For Brazilian residents, Urban Science provides this notice at collection (“Additional Information For Brazil Residents”). The categories of personal information to be collected and the purposes for which the categories of personal information are collected or used is described above in Section II, Collection and Use of Information About You. We will retain and process your personal information as described above in Section III, Additional Information.

Urban Science is the controller of the personal data you provide to it. The other parties with whom Urban Science may share your Personal Data are processors or controllers, as the case may be.

Urban Science collects the personal information described above for a variety of business purposes. Urban Science may use the personal information to:

  • Provide our products and services to automotive manufacturers and dealers;
  • Fulfill our legal and regulatory obligations;
  • Improve, upgrade, or enhance our products and services;
  • Detect security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity;
  • For research and analysis purposes.

Where your consent is required, we will obtain your permission to process your personal data for specific purposes before we process your personal data. You may withdraw your consent at any time.

a) Data subject rights
This section describes certain rights of Brazilian residents under the Lei Geral de Proteção De Dados (LGPD).

You have certain rights under Article 18 of the LGPD, including the rights to:

  • Confirm that we are processing your personal data;
  • Access the personal data we are processing;
  • Correct incomplete, inaccurate, or out-of-date data;
  • Anonymize, block, or delete unnecessary or excessive data or data that is not being processed in compliance with the LGPD;
  • Obtain a portable copy of your personal data (depending on the regulation to be issued by the Brazilian data protection authority);
  • Elimination of personal data processed with your consent, except in the cases where the maintenance of the processing is authorized by LGPD;
  • Information on the public and private entities with which we have disclosed data use;
  • Information on the possibility of not providing your consent and the consequences of refusal;
  • Revoke your consent to the processing your personal data if our processing is based upon your consent; and
  • Request the clauses used for the International Data Transfer, considering commercial and industrial secrets.
